The ADA Amendments Act of 2008 made a number of significant changes to the ADA definition of “disability” to ensure that it would be easier for individuals seeking the protection of the ADA to establish that they have a disability that falls within the meaning of the statute. The Department’s NPRM implements those changes into the ADA title II and title III regulations.
